INFORMATION FROM PERSONAL DATA CONTROLLER (AMEET SP. Z O.O.) PROVIDED IN CONNECTION WITH PROCESSING OF PERSONAL DATA

In order to meet the information obligation referring to personal data protection which results from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (O. J. EU. L. of 2016 No. 119, p. 1) (“GDPR”),

and because we have collected your personal data we would like to inform you about the following:

WHO CONTROLS YOUR PERSONAL DATA?

Your personal data controller, i.e. an entity determining the purposes and means of personal data processing is AMEET Sp. z o.o. (limited liability company) with its registered office in Lodz (contact details: 94-102 Lodz, Nowe Sady 6, tel. +48 42 676-27-78, e-mail address: odo@ameet.pl, www: www.ameet.pl, www.ameet.eu; entered in the register of entrepreneurs of the National Court Register (KRS), for which the company file is kept by the District Court for Łódź – Śródmieście in Łódź, 20th Economic Division, under KRS no. 0000153316, Tax Identification Number NIP 7251008557, with the share capital in the amount of 50,000.00 PLN).

The personal data controller shall be hereinafter referred to as “AMEET”.

WHY DO WE PROCESS YOUR PERSONAL DATA?

Personal data is processed for marketing and commercial purposes, purposes connected with market research: analysis of needs, expectations and market trends; managing sales service and questions sent via e-mail, phone or social media, managing complaints, informing directly about AMEET offer, managing customer relationships and/or for purposes such as marketing, contact, debt collection, statistical analysis, data retention for archiving purposes.

In case of any disputes arising between us your data may be used in order to establish or exercise our legal rights or defend against legal claims. Data processing is lawful since it is necessary for the purposes of the legitimate interests pursued by AMEET as the controller of personal data (Article 6 paragraph 1 point f of GDPR). According to GDPR, processing of personal data for direct marketing purposes may be regarded as carried out for a legitimate interest. While performing these actions we take into consideration your interests and your basic rights and freedoms which require the protection of personal data.

If you win prizes in competitions organized by AMEET your personal data is processed by us to comply with the tax obligation as a taxpayer (processing is then necessary for compliance with a legal obligation to which a controller is subject according to article 6 paragraph 1 point c of GDPR).

DO WE PROCESS YOUR PERSONAL DATA LAWFULLY?

Yes. As stated above, processing of personal data done by AMEET always has legal basis.

IS YOUR PERSONAL DATA SHARED WITH ANYBODY?

AMEET may share the personal data that it is processing with other companies within AMEET group of companies (AMEET Fundacja with it registered office in Lodz; AMEET Studio with its registered office in Lodz; AMEET Verlag with its registered office in Munich) and other entities which support the company’s business and to which the transfer of data is essential for performing certain activities.

Your data might also be disclosed to tax authorities for the purpose of tax settlements in reference to receiving prizes from AMEET. At the same time AMEET assures that processing of personal data by the aforementioned entities shall be performed based on guarantees of implementation of appropriate technical and organisation means so that processing complies with the law and safeguards your rights.

HOW LONG DO WE KEEP YOUR PERSONAL DATA?

AMEET will process your personal data during the period determined by the purpose for which the data has been collected and is processed as well as by law principles.

  1. Personal data collected on the basis of consent will be stored by AMEET during the period stated in the declaration of consent or till the time of withholding the consent.
  2. If it is justified by AMEET legitimate interest (in particular, direct marketing), your personal data will be stored until raising objection against such processing.
  3. Data processed for the purpose of performing an agreement will be stored during the time necessary for its execution. If the agreement shall not take effect, personal data will be stored for 3 years from the moment they are obtained.
  4. In order to document compliance with law principles and to enable certain subjects to carry out an inspection, AMEET is obliged to keep your data In electronic and paper version to provide evidence for accountability.

WHAT CAN YOU REQUEST FROM AMEET IN REFERENCE TO THE DATA CONCERNING YOURSELF?

You have a right to demand the following from AMEET:

  1. access to your personal data,
  2. rectification of inaccurate data,
  3. erasure,
  4. restriction of processing,
  5. data portability.

You also have a right to be notified about the violation of your personal data security if this poses high risk of infringement of your rights or freedoms. The aforementioned rights will be executed in accordance with law principles including GDPR provisions.

DO YOU HAVE ANY OTHER SPECIAL RIGHTS?

Since your data is processed for the benefit of direct marketing you have the right to object at any time to processing of your personal data for this kind of marketing and within the scope of AMEET data processing connected with direct marketing.

If you object to processing of personal data for direct marketing purposes, AMEET shall no longer process your personal data for such purposes.

If processing is based on your consent you have a right to withhold your consent at any time. Withholding your consent shall not influence compliance with the right to process on the basis of consent before it was withheld. You can withhold your consent by submitting a statement via e-mail at odo@ameet.pl.

CAN YOU LODGE A COMPLAINT AGAINST US?

You may lodge a complaint with a supervisory authority that is independent and that monitors the application of the law on the protection of personal data to protect your fundamental rights and freedoms in relation to the processing and facilitation of the free movement of personal data in the European Union. The President of the Office for the Protection of Personal Data has been the supervisory authority in Poland since May 25, 2018 in accordance with new laws adopted on the protection of personal data.

A complaint may be also lodged with a supervisory authority in the Member State of your habitual residence, place of work or place of the alleged infringement.

IS PROVIDING THE DATA VOLUNTARY?

Providing personal data is voluntary unless it is required by law to provide such data or processing is necessary for fulfilling AMEET business goals.

DO WE TRANSFER YOUR DATA TO A THIRD COUNTRY?

Data might be transferred outside the European Economic Area. In each such situation AMEET shall verify if adequate protection is used, in particular, whether the European Commission treats a given third country as ensuring the right level of protection. IS THERE ANYTHING  ELSE TO ADD?

Your data shall not be used to take automated decision, including profiling i.e. automated data processing which makes use of personal data for the purpose of evaluating certain personal traits, in particular for the purpose of analysing or forecasting the economic situation, health, personal preferences, interests, credibility, behaviour, location or relocating.
